This website is owned by The Internet Society Foundation, 11710 Plaza America Drive, Suite 400, Reston, Virginia 20190. These TERMS AND CONDITIONS FOR USE (“Terms and Conditions”) are made between The Internet Society Foundation and any person (“User”) who uses or visits this website (an “Internet Society Foundation Website”). This Agreement applies to the Internet Society Foundation websites (“Sites”), mobile sites, applications (“apps”), and other content and services that are linked to this Agreement.
BY USING AND/OR VISITING AN INTERNET SOCIETY FOUNDATION WEBSITE, INCLUDING ALL CONTENT AVAILABLE THROUGH THE INTERNET SOCIETY FOUNDATION WEBSITE, YOU SIGNIFY YOUR CONSENT AND AGREEMENT TO THESE TERMS AND CONDITIONS. 1. Ability to Accept Terms and Conditions
1.1 You affirm that you are either 18 years of age or older, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions.
1.2 You affirm that you are over the age of 13, as the Internet Society Foundation Website is not intended for children under 13.

2. Website Access and Use
2.1 The Internet Society Foundation hereby grants you permission to use the Internet Society Foundation Website as set forth herein, provided that:
2.1.1. Your use of the Internet Society Foundation Website is in accordance with the Internet Society’s “Sharing Our Content” Policy, https://www.internetsociety.org/sharing-our-content/;
2.1.2. You may only copy or distribute content on the Internet Society Foundation Website in accordance with the Internet Society’s “Sharing Our Content” Policy, https://www.internetsociety.org/sharing-our-content/;
2.1.3 You will not alter or modify any part of the Internet Society Foundation Website; and

The Internet Society Foundation reserves the right to revoke these exceptions either generally or in specific cases.
3. Links To and From the Internet Society Foundation Website
3.1 The Internet Society Foundation Website may contain links to third party websites that are not owned or controlled by the Internet Society Foundation, and such links should not be interpreted as an endorsement of any company, content or products to which the Internet Society Foundation Website links. The Internet Society Foundation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.
3.2 The Internet Society Foundation disclaims any and all warranties, express or implied, to any such linked sites, including but not limited to any terms as to the accuracy, ownership, validity or legality of any content of a linked website. By using the Internet Society Foundation Website, you expressly relieve the Internet Society Foundation from any and all liability arising from your use of any third-party website.
3.3 The Internet Society Foundation permits you to link to the Internet Society Foundation Website as detailed in the Internet Society’s “Sharing Our Content” Policy, https://www.internetsociety.org/sharing-our-content/.
4. Intellectual Property Rights
4.1 The Internet Society Foundation trademarks, service marks and logos on the Internet Society Foundation Website are owned by or licensed to the Internet Society Foundation, its affiliates or associates, and are subject to copyright, trademark, and other intellectual property rights under applicable laws.
4.2 The Internet Society Foundation Website may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for purposes not expressly authorized herein without the prior written consent of the Internet Society Foundation.

5. Warranty Disclaimer

6.1 IN NO EVENT SHALL THE INTERNET SOCIETY FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM (I) YOUR ACCESS TO AND USE OF THE Internet Society FoundationWEBSITE, (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE INTERNET SOCIETY FOUNDATION WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH THE INTERNET SOCIETY FOUNDATION WEBSITE, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY INTERNET SOCIETY FOUNDATION WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE INTERNET SOCIETY FOUNDATION IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FEDERAL LAW, SOME STATES, PROVINCES, AND OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU. THESE TERMS AND CONDITIONS GIVE YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION. THE EXCLUSIONS AND LIMITATIONS HEREUNDER WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
7. Indemnity
7.1 You agree to defend, indemnify and hold harmless the Internet Society Foundation, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your violation of any term of these Terms and Conditions; (ii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iii) your use of any content made available to you via the Internet Society Foundation Website. This defense and indemnification obligation will survive termination of these Terms and Conditions and your use of the Internet Society Foundation Website.
8. Termination
8.1 The Internet Society Foundation reserves the right to discontinue, modify, and alter any and all aspects of the Internet Society Foundation Website at any time and without notice.
8.2 The Internet Society Foundation reserves the right to immediately terminate your access to the Internet Society Foundation Website if the Internet Society determines that you are in breach of the Terms and Conditions.
9. General Terms
9.1 You agree that: (i) the Internet Society Foundation Website shall be deemed solely based in the Commonwealth of Virginia; (ii) the Internet Society Foundation Website shall be deemed a passive website that does not give rise to personal jurisdiction over the Internet Society Foundation, either specific or general, in jurisdictions other than the Commonwealth of Virginia, and (iii) by accepting the Terms and Conditions you are submitting yourself to the jurisdiction of the Commonwealth of Virginia, USA for any issues related to the Terms and Conditions and/or your use of the Internet Society Foundation Website and/or your transactions with the Internet Society Foundation.
9.2 These Terms and Conditions shall be governed by the laws of the Commonwealth of Virginia without respect to its conflict of laws principles. Any claim or dispute between you and the Internet Society Foundation that arises in whole or in part from the Internet Society Foundation Website shall be decided exclusively by a court of competent jurisdiction located in the Commonwealth of Virginia. These Terms and Conditions, together with any other legal notices published by the Internet Society Foundation on the Internet Society Foundation Website, shall constitute the entire agreement between you and the Internet Society Foundation concerning the Internet Society Foundation Website.
9.3 If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
9.4 No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term, and the Internet Society Foundation’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
9.5 The Internet Society Foundation reserves the right to amend these Terms and Conditions at any time and without notice, and it is your responsibility to review these Terms and Conditions for any changes. When the Internet Society Foundation updates the Terms and Conditions, the Internet Society Foundation will update the “Last Modified” date at the top of this page. Your use of the Internet Society Foundation Website following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms.
9.6 To the fullest extent permissible under applicable law, you and the Internet Society Foundation agree that any cause of action arising out of or related to the Internet Society Foundation Website must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently time barred.
